Welcome to the Toronto Climbing Club (“TCC,” “we,” “us,” or “our”). By accessing our website www.torontoclimbingclub.ca and our application tccapp.ca (collectively, the “Services”), you agree to be bound by the following Terms of Service. Please read them carefully.

1. Acceptance of Terms

By using our Services, you represent that you are at least 18 years of age (or have parental/guardian consent) and that you agree to comply with all applicable laws and regulations in Ontario and Canada.

2. User Accounts

To access certain features of the Services, such as event registration or raffles, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials.

  • All activities that occur under your account.

  • Notifying us immediately of any unauthorized use of your account.

3. Use of Services & Prohibited Conduct

You agree to use our Services only for lawful purposes related to the climbing community. You are prohibited from:

  • Using the Services to harass, abuse, or harm others.

  • Attempting to gain unauthorized access to the application’s backend or other users' data.

  • Using the Services for unauthorized commercial solicitations.

  • Posting or distributing content that is defamatory, obscene, or infringing on intellectual property.

4. Community Events and Raffles

  • Events: Participation in events organized by TCC (e.g., at MEC or other GTA locations) may require separate physical liability waivers. These digital Terms of Service do not supersede event-specific safety requirements.

  • Raffles: All raffle entries are final. TCC reserves the right to modify raffle prizes or rules at its discretion. Winners are responsible for any applicable taxes.

5. Intellectual Property

All content on the Services—including text, logos, graphics, and code—is the property of the Toronto Climbing Club or its licensors and is protected by copyright and trademark laws. You may not use our branding (including the TCC logo) without express written permission.

6. Third-Party Links and Tools

Our Services may contain links to third-party websites (such as partner sites like Arc'teryx or MEC) or integrate with third-party tools (such as Google Cloud APIs). We are not responsible for the content, privacy policies, or practices of any third-party services.

7. Disclaimer of Warranties

The Services are provided on an "as-is" and "as-available" basis. TCC makes no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the website or application. We do not guarantee that the Services will be error-free or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by law, the Toronto Climbing Club and its founders shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.

9. Modifications to Terms

We reserve the right to update these Terms of Service at any time. We will notify users of significant changes by updating the "Last Updated" date at the top of this page. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
